JUSTICE MUNGESHWAR SAHOO ORAL ORDER 22-04-2016 From perusal of order dated 20.04.2015 passed by Principal Judge, Family Court, Patna in Matrimonial Case No.837 of 2011, it appears that the court below after considering the cases of both the parties and allegation regarding income recorded a finding of fact that the monthly income of the petitioner should not be less than Rs.25,000/- per month and considering the day to day requirement of the opposite party-wife directed the petitioner to pay Rs.5,000/- per month as maintenance under Section 24 of the Hindu Marriage Act, 1955.

As stated above from perusal of the impugned order, it cannot be said that the order passed by the court below is illegal or that it occasioned failure of justice. Further the order passed by the court below does not touch the jurisdiction of the Court. I, therefore, find no reason to interfere with in the impugned order. Thus, this writ application is dismissed.
