The petitioner seeks regular bail in connection with Kudra P.S. Case No.94 of 2015 for the offences punishable under Section(s) 409 and 420 of the Indian Penal Code. The present case arises out of impugned order dated 15.03.2018 whereby and whereunder the regular bail of the petitioner has been rejected. It may be pointed out that the petitioner had already been granted anticipatory bail by this Court by an order dated 16.07.2015 passed in Cr. Misc. No.26195 of 2015, however, the petitioner, after being granted anticipatory bail, failed to be either be present before the Special Court or ensure representation on his behalf before the Special Court,

Patna High Court Cr.Misc. No.25148 of 2018 (3) dt.28-05-2018 2/2 hence the bail bond for the petitioner was cancelled. Having regard to the facts and circumstances of the present case as also the reasons mentioned in the present petition, I deem it fit and proper to direct for release of the petitioner on bail subject to the petitioner deposit sum of Rs. 2500/- with the Patna High Court Legal Services Committee, Patna.

It is directed that in case the petitioner deposits the aforesaid sum of Rs.2500/- within a period of three weeks from today and produces the receipt thereof before the concerned trial Court, the concerned trial Court shall release the petitioner on regular bail subject to such condition as may be imposed by the learned C.J.M., Gaya, in connection with Kudra P.S. Case No. 94 of 2015. Accordingly, this petition is disposed of.
