This application for grant of anticipatory bail arises out of Chandi P.S. Case No. 22 of 2016, disclosing offences under Sections 147, 441, 323, 324, 307 and 379 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner has submitted that before lodging of the present First Information Report, First Information Report bearing Chandi P.S. Case No. 21 of 2016 was registered, in which, the informant and others have been made accused. The said First Information Report contained allegation of misbehaviour with the female members of the petitioner's family. Learned counsel for the petitioner has submitted that there is false
Patna High Court Cr.Misc. No.36870 of 2016 (2) dt.14-09-2016 2/2 allegation against the petitioner of opening fire, which did not hit any one. It has been stated in paragraph 3 of the application that the petitioner has no criminal antecedent.
Considering the submissions as above, this application is allowed.
Let the petitioner, above-named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Chandi P.S. Case No. 22 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
