NILU AGRAWAL ORAL ORDER 20-05-2015 Heard learned counsel for the petitioner, learned counsel for the opposite party no. 2 and learned A.P.P. The petitioner apprehends his arrest in connection with Jehanabad Mahila P.S. Case No. 104 of 2013 for offences punishable under Sections 498A, 323, 379, 504, 506 and 494/34 of the Indian Penal Code.
The prosecution case is that the marriage of the informant, who is the wife of the petitioner was solemnized with the petitioner Pradip Kumar @ Praveen and she went to her sasural where she started living peacefully. After sometime the
Patna High Court Cr.Misc. No.4492 of 2015 (4) dt.20-05-2015 petitioner along with other accused persons started torturing the informant mentally and physically and demanded Rs. 5,000,00/- as dowry. Due to non- fulfillment of demand the informant was forced to leave her matrimonial house. It has further been alleged in the First Information Report that the petitioner Pradip Kumar @ Praveen the husband has married another woman Sweety Kumari.
Be that as it may, the petitioner undertakes to take the opposite party no.2 to the matrimonial house and is ready to keep her with honour and dignity.
Under such circumstances, the above named petitioner is directed to be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad Mahila P.S. Case No. 104 of 2013, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. May it be clarified that if the petitioner, husband of the informant, does not fulfill his undertaking, this order would be deemed to not have been passed. The petitioner husband will appear before the learned Chief Judicial Magistrate, Jehanabad on 25.05.2015 and the informant the wife Sima Kumari @ Babli will also appear before the court of learned
Patna High Court Cr.Misc. No.4492 of 2015 (4) dt.20-05-2015 Chief Judicial Magistrate Jehanabad on 25.05.2015 at 10.30 A.M. and she will be taken by the petitioner to her matrimonial house.
With this observation, this application is disposed of.
