The petitioner apprehends his arrest in Didarganj P.S. Case No.105 of 2020 registered under Sections 30(c)(d) and 36 of the Bihar Prohibition and Excise Act.
The informant after having received information intercepted a Honda City Car bearing Registration No.WB02Z4575. On opening of the dicky, empty bottles of liquor of different brands were recovered. Three persons, namely, Sonu Kumar, Sintu Kumar and Updesh Kumar were apprehended. They disclosed the names of Tripurari Kumar (petitioner) and Ankit Singh, who managed to flee away.
Learned counsel for the petitioner submits that there is nothing on record to show the involvement of the petitioner in the alleged crime. Three persons were apprehended on the spot
Patna High Court CR. MISC. No.36287 of 2020(2) dt.09-04-2021 2/2 and they are said to have disclosed the name of the petitioner. The petitioner is not the owner of the vehicle. Having considered the facts that nothing has been recovered from possession of the petitioner and the name of the petitioner surfaced in the so-called confessional statements of the accused, who were apprehended on the spot, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Didarganj P.S. Case No.105 of 2020, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
