ANJANA MISHRA ORAL ORDER 20-05-2015 Heard learned counsel for the petitioners and the learned counsel for the State.
The petitioners are apprehending their arrest in connection with Pupari P.S. Case No.2 of 2015 for allegedly having committed the offences under Sections 341, 323, 324, 325, 504, 506, 448 and 379/34 of the Indian Penal Code and Section 3(i)(x) of the S.C./S.T. Act.
Learned counsel for the petitioners submits that the provisions of the S.C./S.T. Act have been brought in only to embellish the case and make the offence more serious. Learned counsel further submits that, in fact, the occurrence has taken place at the doorstep on the informant and not at any public place nor in public view. Learned counsel submits that earlier
Patna High Court Cr.Misc. No.8128 of 2015 (3) dt.20-05-2015 2/2 case has been registered against the informant's side. As a counterblast to the said case, the present case has been instituted. It is further submitted that there is a land dispute between both the parties with respect to measurement, for which Measurement Case No.20/2004-05 has been instituted and the petitioner's side has deposited the measurement fee on 14.3.2004.
Considering the aforementioned submissions and also the fact that the petitioners have got no criminal antecedents, let the above named petitioners, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Pupri at Sitamarhi, in connection with Pupari P.S. Case No.2 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
