JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.

It is alleged against co-accused Luxman Singh that he assaulted the brother of the informant when the petitioner assaulted with garasa to Kameshwar Singh and when the informant came to rescue then he was also assaulted by the petitioner.

It is submitted by learned counsel for the petitioner that there is no injury report of the informant on record and brother of the informant received only one incised injury of marginal size when Kameshwar Singh has not received any injury by sharp

Patna High Court Cr.Misc. No.24406 of 2015 (2) dt.29-06-2015 2/2 cutting weapon. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Moreover, the occurrence took place in the background of land dispute. It is further submitted that petitioner has already been appointed in Northern Coalfields Limited.

Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for three months, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan in connection with Raghunathpur P.S. Case No. 178 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. The provisional bail of the petitioner will be confirmed by the learned court below on verification of the fact that the injury caused by the petitioner has not been found to be grievous.
