====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-09-2024 Heard learned counsel for the petitioners and Mr. Pramod Kumar Pandey, learned A.P.P. for the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 307, 379/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, on the alleged date and time of the occurrence, petitioner No. 2 assaulted Bikrant Yadav and petitioner No. 1 assaulted Mukesh Yadav by means of spear. Reason for the occurrence is said to be old political rivalry between the parties.

4. Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.43495 of 2024(3) dt.02-09-2024 2/2 injuries allegedly caused by these petitioners are simple in nature. There is no allegation of repetition of assault against these petitioners. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the simple nature of injuries, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Sandesh P. S. Case No. 27 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
