JUSTICE ARUN KUMAR ORAL ORDER 16-02-2017 Heard learned counsel for the petitioner and the State. Petitioner is in custody in connection with Asaon P.S. Case No. 122 of 2016 registered under sections 272, 273 and 308 of the Indian Penal Code and Section 30 of the Bihar Prohibition and New Excise Amendment Act, 2016.

Allegation is that this petitioner was selling foreign liquor in his paint shop in total 96 bottles of foreign liquor each containing 180 ml.

It is submitted that the recovery was not from the shop and this petitioner has been in custody since 25.12.2016 and has got no criminal antecedent.

Considering the said facts and circumstances, the petitioner, namely, Ram Ekbal Prasad @ Ram Ekbal Yadav @

Case No. 122 of 2016.
