JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Andhratharhi P.S. Case No.2 of 2018 for the offence under Sections 364, 365/34 of the Indian Penal Code. Learned counsel for the petitioner submits that from perusal of the statement made under Section 164 of the Cr.P.C., it would be transpired that the petitioner has no role in the commission of crime. The petitioner is languishing in jail since 17.01.2018.
From the stamp report, it appears that co-accused, namely, Ram Swarup Mehta @ Ram Swarup Mahto has been granted bail vide order dated 04.04.2018 in Cr. Misc. No. 18938 of 2018, Sudhir Kumar Mishra @ Sudhir Mishra has been granted bail vide order dated 10.04.2018 in Cr. Misc. No. 19489 of 2018
Patna High Court Cr.Misc. No.28658 of 2018 (3) dt.06-07-2018 2/2 and Pramila Devi has been granted bail vide order dated 11.04.2018 in Cr. Misc. No. 19627 of 2018.
Considering the aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Madhubani in connection with Andhratharhi P.S. Case No. 2 of 2018.
