JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 34 of the Indian Penal Code and Sections 47(A), 54 of Bihar Excise (Amendment) Act, 2016.
Near about 77 bottles containing 37 litres of Indian made foreign liquor are said to have been recovered from possession of the petitioner and co-accused, Pramod Singh, who happens to be father of the petitioner.
Submission on behalf of the petitioner is that coaccused, Pramod Singh has already been granted privilege of bail by a co-ordinate Bench of this Court whereas petitioner is in jail custody since long.
Patna High Court Cr.Misc. No.33724 of 2016 (3) dt.17-10-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Sheikhpura in connection with Karendey P.S. Case No. 25 of 2016.
