Petitioners are in custody in Khusrupur P.S. Case No.189 of 2016 registered under Sections 25(1-b)/A/26 of the Arms Act.

Allegation in brief is that one country made pistol and one cartridge each was recovered from each petitioners of this case.

Submission is that petitioner no.2's wife sold a piece of land in favour of the wife of the Officer-in-Charge of Khusrupur Police Station and thereafter he insisted and started giving pressure to the petitioners to sell another piece of land situated on the road side but the petitioners refused then they were

Patna High Court Cr.Misc. No.6815 of 2017 (3) dt.23-02-2017 2 / 2 made accused in a number of Arms Act cases thereafter. This case is in chain of one of those cases. Before that these petitioners have no criminal antecedent. Charge-sheet has already been submitted in this case and other co-accused from whose possession cartridges were recovered have been granted bail by a coordinate Bench of this Court vide Cr. Misc. No.53763 of 2016. Having considered the said facts and circumstances, let the petitioners, namely, Pikku Kumar @ Pinku Kumar @ Pintu Kumar and Upendra Kumar @ Phatal Singh @ Balmiki Prasad @ Balmiki Singh @ Patthal Singh be released on bail on furnishing bail bond of Rs.

10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna City, in connection with Khusrupur P.S. Case No.189 of 2016, with the condition that the petitioners shall present physically on each and every date before the trial court and in case of failure on two consecutive dates, their bail bond shall be liable to be cancelled.
