JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 07-01-2016 Though instant petition has been listed under the heading to be mentioned at the instance of respondent no.1 who under I.A. No.7597 of 2014 brought order dated 11.04.2012 passed in CWJC No.20979 of 2011 where from it is evident that on account of deposit of principal amount along with interest so due, the petitioner of this case namely State Bank of India had under took to withdraw this petition in the background of the fact that after having saturation of due amount, the bank was not interest to proceed furthermore with the proceeding launched under SARFAESI Act.
Patna High Court CWJC No.20863 of 2011 (4) dt.07-01-2016 Learned counsel for the petitioner is present and submits that on account of saturation of amount, petitioner did not want to proceed furthermore with the instant petition which could be dismissed as withdrawn.
Accordingly, dismissed as withdrawn.
