JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 22-05-2017 Heard learned counsel Shri Lal Babu Keshari for the petitioner and learned counsel Sri Madan Kumar for the State. The petitioner seeks bail in Shahkund P.S. Case No. 34 of 2016 under Sections 147, 148, 149, 323, 385, 379, 307, 504 and 506 of the Indian Penal Code.

The learned counsel for the petitioner submits that the present case has arisen because of the ongoing land dispute between the petitioner and the informant. No overt act has been committed by the petitioner and the petitioner has got no criminal antecedent. The co-accused Ranjeet Mahto has been granted bail vide Annexure-3 to the bail application.

Learned counsel for the State could not place any material to show that there is any direct allegation against the

In the facts and circumstances of the case, the petitioner Chhatari Mahto @ Kshatriya Mahto be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Bhagalpur in connection with Shahkund P.S. Case No. 34 of 2016.
