JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-05-2018 The petitioner seeks bail in connection with Amas P.S. Case No. 74 of 1998 instituted for the offences under Sections 395, 397 of the Indian Penal Code.

A burglary was committed in the house of the informant and belongings of the house were taken away. The F.I.R with respect to the occurrence was lodged against unknown. Much later, the name of the petitioner transpired during the course of investigation.

The learned counsel for the petitioner has submitted that earlier also the petitioner was made accused in a case of similar nature on suspicion but was granted bail by the learned Court below. The petitioner along with his family members had been out of the State of Bihar for earning his

Patna High Court Cr.Misc. No.25214 of 2018 (3) dt.17-05-2018 2/2 livelihood and did not have any idea about his name being dragged in the present case.

The petitioner is in custody since 29.01.2018. Considering the aforesaid facts as also taking into account the period of custody of the petitioner, the petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sherghati, Gaya in connection with Amas P.S. Case No. 74 of 1998.
