1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of anticipatory bail apprehending her arrest in connection with Mehendiya P.S. Case no.208 of 2023 registered under sections 307, 323, 324, 328, 341, 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution case, the informant states that her sister was married to the son of the petitioner herein. The informant's sister was tortured, abused and assaulted. Thereafter, the accused persons forcibly made her to drink pesticide as a result of which she fell unconscious. Information about this was given to the informant by the neighbours.

4. Learned counsel for the petitioner submits that the petitioner happens to be the mother-in-law of the sister of the informant. The allegations levelled against her are all false and

It is submitted that there is an unexplained delay of 3 days in giving information about the occurrence to the police as also in registration of the F.I.R. Further the statement of the victim was recorded in course of investigation wherein so far as the allegations of forcibly making her drink the pesticide is concerned, it is only against the husband and not the petitioner herein. There has been a case under section 498A of the Indian Penal Code in the past and the petitioner has no concern with the affairs of her son and daughter-in-law, who happens to be the sister of the informant. The petitioner is an aged lady and undertakes to cooperate in the investigation/trial.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., the material that has transpired in course of investigation especially the contents of the statement of the victim sister of the informant together with the petitioner being a lady, in the facts of the case it is directed that the petitioner above named, in the event of her arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in
