JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-05-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code. It is alleged that co-accused Pramod Kumar Pandey assaulted the informant with farsa and when the informant fell down then petitioner no.1 assaulted him with iron rod causing fracture injury on the leg and petitioner no.2 assaulted with lathi. It is submitted by learned counsel for the petitioners that the injury alleged to have been caused by petitioner no.2 has not been found by the doctor while examining the informant. There is counter versions of the occurrence also and petitioners' side also received injuries. A statement has been made in para 3 of the

Patna High Court Cr.Misc. No.15037 of 2015 (3) dt.21-05-2015 2/2 petition that the petitioners have no criminal antecedent. The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Ghoghardiha P.S. Case No. 36 of 2014 pending in the court of learned SDJM, Jhanjharpur. Accordingly, the application is disposed of.
