JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 47(A) of the Excise Act and G/53 Bihar Excise Amendment Act, 2016.

Near about 47 litres liquor kept in several bottles were recovered from a maruti van and petitioner and two others were found sitting in the said van. However, one co-accused, namely, Dewanand Kumar @ Dewanand Kuar, who was caught along with the petitioner and one other, has already been granted privilege of bail by a co-ordinate Bench of this Court. With an intent to maintain the parity of justice, let the petitioner be released on bail on furnishing bail bonds of Rs.

Patna High Court Cr.Misc. No.30541 of 2016 (2) dt.05-08-2016 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Dihari, District-Rohtas at Sasaram in connection with Rohtas P.S. Case No. 90 of 2016.
