The petitioner seeks bail in connection with Bharahi (Madhepura) P.S. Case No. 278 of 2016 registered for the offences punishable under section 414 of the Indian Penal Code and Section 25(1b) and 35 of the Arms Act as also under section 47(a) of the Bihar Excise Act.

Regard being had to the recovery of one country made loaded Pistol from possession of the petitioner, who is in custody since 21.05.2016, I am not inclined to grant him bail for the present. Accordingly, this application for bail is rejected. However, in case the trial of the petitioner is not concluded within

Patna High Court Cr.Misc. No.35211 of 2016 (2) dt.20-08-2016 six months from the date of framing of charge, the petitioner would be at liberty to renew his prayer for bail in the court below itself.
