The petitioner is languishing in custody for the offences punishable under Sections 147/148/149/324/326/307/506 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner is that he fired causing injury to Anandi Yadav.

Submission is that the case-diary would reveal that there is no injury report of Anandi Yadav whereas injury reports against other injured are there. Co-accused Ram Chandar Yadav, Shankar Yadav and Indradeo Yadav against whom the allegation is specific have already been allowed bail by different coordinate Benches of this Court vide Annexure-2 series. Patna High Court Cr.Misc. No.12650 of 2018 (3) dt.24-04-2018 P2/ custody since 07.11.2017.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bodhgaya P.S. Case No.74 of 2015, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
