The petitioner is a Night Guard and would fall within the definition of workmen as per the Industrial Disputes Act, 1947.

Taking into consideration the statutory forum of redressal of disputed under Section of the Industrial Disputes Act, 1947, the petitioner is left free to approach the concerned Labour Court directly for redressal of the grievance. If such dispute is raised the concerned Labour Court shall consider and decide the same preferably within a period of one years.
