JUSTICE SUDHIR SINGH ORAL ORDER 30-04-2015 The petitioner is apprehending his arrest in connection with Nathnagar P.S.Case No. 282/2014 instituted under Sections 147,149, 323, 324, 325, 307, 427 and 504 of the Indian Penal Code.
Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that on 9.10.2014 at about 12 O' clock, the petitioner and other FIR named accused persons came with lathi, danda and indulged into abuse scuffle and assaulted the informant, his brothers and sons with lathi danda with an intent to kill them. It is further alleged that the informant, his brothers and son sustained injuries on their heads and other parts of the body It is submitted on behalf of the petitioner that specific
Patna High Court Cr.Misc. No.49727 of 2014 (2) dt.30-04-2015 2/2 allegation is against one Shankar Yadav. So far petitioner is concerned, omnibus and general allegation has been made. Further the injury report, Annexure 2, shows that the injuries sustained are simple in nature. It is further submitted that there is a case and counter case. Counter Case is Nathnagar P.S.Case No. 284 of 2014 u/s 307 and other sections of the Indian Penal Code. On behalf of the State it is submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.,Bhagalpur, in connection with Nathnagar P.S.Case No. 282/2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
