JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-05-2015 The present application has been filed for modification of the order dated 20.10.2014 passed in Cr. Misc. No. 25749 of 2014 to the extent of additional condition for attending the court regularly till disposal of the case and in case of failure on two consecutive dates or violation of undertaking, without giving any reasonable explanation, the privilege granted was directed to be deemed to be cancelled.

The petitioner being the husband of the complainant was granted anticipatory bail by a co-ordinate Bench of this Court in Complaint Case No. 133 of 2010 pending in the court of learned CJM, Sasaram, Rohtas wherein process was directed to be issued after cognizance being taken for the offences punishable under Section 498A of the IPC and Section 4 of the Dowry Prohibition Act.

It is submitted by learned counsel for the petitioner that the petitioner is an army personnel and it is difficult for him to

Considering the same, the order dated 20.10.2014 passed in Cr. Misc. No. 25749 of 2014 is modified to the extent that learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for three consecutive occasions and due to such defaults the substantial progress of trial is impeded. Accordingly, the modification application is disposed of.
