The petitioner is in custody since 24.01.2018 in connection with Gardanibagh P.S. Case No. 53 of 2018 for the offence registered under Sections 417 and 420 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been taken into custody on mere suspicion as it is alleged that the signature in biometric process does not match with the thumb impressions at the Physical Fitness Test. It is further submitted that several similarly situated coaccused persons have been extended the privilege of regular bail vide order dated 19.04.2018 passed in Cr. Misc. No.

Patna High Court Cr.Misc. No.25638 of 2018 (3) dt.07-05-2018 2/2 21944 of 2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Judge XIV-cum-A.C.J.M., Patna in connection with Gardanibagh P.S. Case No. 53 of 2018.
