JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Section 406 of Indian Penal Code. As per FIR, this petitioner along with his brother Rakesh Kumar took Rs. 9,75,000/- from the informant and assured to return the money upto 31.12.2018 but did not return the same till date.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case and petitioner has not taken a single rupee from the informant. No chit of paper or document has been filed in support of the allegation. It is further submitted that petitioner and informant are distinct relative and due to petty dispute this false and concocted case has been lodged. Petitioner has got clean antecedent.

No.40491 of 2022(2) dt.28-11-2022 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in Kiul P. S. Case No. 63 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
