2. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 395 of the Indian Penal Code .

3 . It is alleged that some unknown miscreants had waylaid the informant, while he was returning after making morning collection , on 05.02.2021 at about 8: 30 a.m. and then the said miscreants had snatched his bag containing a sum of Rs. 1,37,000/- Lenovo tab and other articles.

4. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. The name of the petitioner transpired during course of investigation in confessional statement of co-accused persons. No incriminating

Patna High Court CR. MISC. No.43023 of 2024(2) dt.23-08-2024 2/2 material has been recovered from the conscious possession of the petitioner. Similarly situated co-accused persons namely have already granted bail by this Court, namely Arvind Sahani vide order dated 20.05.2024 in Cr. Misc. No. 25086 of 2024 , co-acused Sanoj Kumar vide order date 20.02.2024 passed in Cr. Misc. No. 30010 of 2023 and co-accused Chandan Paswan vide order dated 23.01.2023 passed in Cr. Misc. No. 60733 of 2022. Petitioner is in custody since 06.01.2024 . 5 . Considering the period of custody and the fact that co-accused having identical allegation have already been granted bail, prayer for bail of the petitioner is allowed.

6. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - III Vaishali at Hajipur in connection with Baligaon Police Station Case No. 16 of 2021 .
