The petitioner seeks bail in Sheikhpura P.S. case No. 311 of 2013 under Section 302 and some other Sections of the Indian Penal Code.

The informant, widow of the deceased, alleged that while she along with her husband and sister-in-law was returning from the block office, the petitioner Ranjit Yadav and seven others dragged her husband and they all assaulted her husband. The learned counsel for the petitioner submits that case of the petitioner stands on same footing as that of Sukhdeo Yadav, Rabo Yadav, Baleshwar Yadav, Kuldeep Chauhan and others. They all have been granted bail vide order passed in Cr. Misc. 18870 of 2015, 36448 of 2015 and Cr. Misc. No. 31349 of 2015 respectively. The petitioner is in jail since 13.04.2016.

No.31645 of 2016 (5) dt.18-11-2016 2/2 It appears that prayer for bail of co-accused Sukhdeo Yadav, Rabo Yadav, Baleshwar Yadav was rejected earlier but Sukhdeo Yadav was granted bail vide order dated 29.07.2015 passed in Cr. Misc. No. 18870 of 2015. Thereafter, Rabo Yadav and Baleshwar Yadav were granted bail and Kuldeep Chauhan was granted bail vide order dated 01.12.2015 passed in Cr .Misc. No.31349 of 2015. The case of petitioner stands on same footing. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in Sheikhpura P.S.
