Having regard to the nature of allegation against the petitioner for offence under Sections 407 and 407/34 of the Indian Penal Code and the finding arrived in course of investigation on the basis of the Sim card, the involvement of the petitioner (Khalasi) along with the driver in the misappropriation of 20,000 litres of diesel is apparent, and therefore, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
