JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-11-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 47(A), 53(c), 54 of Bihar Excise (Amendment) Act, 2016.

In huge quantity country made liquor and other apparatus, which are used in manufacturing the country made liquor, were recovered on the bank of a river. Petitioners are said to have been caught by the police while they were making attempt to flee from there.

Submission on behalf of the petitioners is that

Patna High Court Cr.Misc. No.37185 of 2016 (5) dt.10-11-2016 2/2 petitioners do not have any criminal antecedent and as a matter of fact, they were caught by the police on mere suspicion while they were going on a motorcycle.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Mufashil (Lakhaura) P.S.
