JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 01-11-2021 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Bhabua (Mahila) P.S. Case no. 28 of 2020 instituted for the offence under Sections 341, 323, 171, 419, 420, 467, 468, 498A, 504 and 506/34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act.
As per complaint petition, petitioner has solemnized marriage with the complainant with an impression that he was as a service man in the C.I.S.F. and an amount of Rs. 12 lakh and one Apache motorcycle was given to him as dowry. Learned counsel appearing on behalf of the petitioner
Patna High Court CR. MISC. No.1668 of 2021(2) dt.01-11-2021 2/2 has submitted that petitioner is innocent and has committed no offence. He is brother of the husband of the complainant. He is living separately from the informant's family. He has got no criminal antecedent. Husband of the complainant has already been granted regular bail by a co-ordinate Bench of this Court. Learned APP has opposed the prayer of bail.
Having heard learned counsel for the parties and considering the fact that petitioner is brother-in-law of the complainant, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Bhabua (Mahila) P.S. Case no. 28 of 2020, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., I/C Bhabua Distt- Kaimur at Bhabua subject to the conditions as laid down under section 438(2) of the Cr.P.C.
