2. The petitioner seeks bail in a case registered for the offence punishable under Sections 8, 20(b), (ii)(c)/22 of the N.D.P.S. Act.

3. Petitioner and two other co-accused persons named in the FIR procures Ganja from the State of Tripura, stores it in their houses and are engaged in selling of Ganja.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that no any contraband article has been recovered from the possession of the petitioner. He submits that no any independent witness has supported the prosecution case. He submits that charge has been framed in this case. He further submits that petitioner has no criminal antecedent as stated in

Patna High Court CR. MISC. No.44582 of 2024(2) dt.02-08-2024 2/2 para-3 of the bail application and he is languishing in judicial custody since 19.01.2024.

5. Learned APP for the State opposes the prayer for bail.

6. Considering the facts and circumstances of the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Pirpainti P.S. Case No. 118 of 2022, subject to the conditions:

(i) The petitioner shall co-operate in the trial. (ii) The petitioner will mark his attendance in the local police station in the first week of every month till conclusion of trial, failing which the prosecution will be at liberty to move cancellation of his bail bond.
