This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 504, 376/511 of the Indian Penal Code and under Section 3(i)(x)(xii) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
In compliance of the order of this Court dated 22.01.2015, the case diary of SC/ST (Motihari) P.S. Case No. 10 of 2014 is available.
Learned Additional Public Prosecutor appearing on behalf of the State does not dispute that the occurrence had taken
Patna High Court Cr.Misc. No.3008 of 2015 (3) dt.21-05-2015 2/2 place because of some petty dispute between the parties and the prosecution case as alleged in the First Information Report has not been found to be correct.
In view of the submission as above, let the petitioners, abovenamed, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with SC/ST (Motihari) P.S. Case No. 10 of 2014 (G.R. Case No. 215 of 2014), subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Chakradhari Sharan Singh, J.) Vats/- U T
