In this case, the petitioner is seeking bail in connection with Banka P.S. Case No. 203 of 2016 registered for offences under sections 366A/34 of the Indian Penal Code. The first information report was lodged that the daughter of informant had gone to attend a call of nature, but she did not return. Apprehension has been shown that the accused persons are involved in taking away her for the purpose of marriage.
From the record it appears that she attained the majority in view of the Matriculation Certificate, on calculation it comes, she is aged 20 years and so much so that she has entered
Patna High Court Cr.Misc. No.27001 of 2016 (2) dt.12-07-2016 2/2 into marriage which is apparently clear from the certificate granted by Arya Samaj Vedic Vivah Mandal in Ghaziabad (U.P.) and also attached registered marriage deed and the joint affidavit. Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 203 of 2016.
