The petitioner seeks bail in Turkauliya P.S. case No. 23 of 2016 under Section 384, 379 and other Sections of the Indian Penal Code.
The informant alleged that petitioner and others came to his land and demanded extortion of Rs. 20 lacs. The accused persons also assaulted the informant.
The learned counsel for the petitioner submits that informant purchased a piece of land of Khata No. 205, Khesra No. 1014, area 5.8 decimal, from Sunil Kumar Mishra. In fact the aforesaid land belongs to Jokhan Sahni, son of Bengali Sahni, and the petitioner purchased the land from Jokhan Sahni that is why the informant lodged the case so that petitioner may not make his claim over the land. It is submitted that on perusal of Annexures-2
Patna High Court Cr.Misc. No.14908 of 2017 (2) dt.20-04-2017 2/2 and 3 of the bail petition, it would appear that there is land dispute between both sides as the informant also purchased the same land but the petitioner purchased the land from its real owner. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in Turkauliya P.S.
