JUSTICE SUDHIR SINGH ORAL ORDER 05-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 399, 402, 420, 467, 468, 272 and 273 of the Indian Penal Code and 25(1-b), 26 and 35 of the Arms Act and 47 (A) of the Bihar Excise Amendment Act.

Allegation against petitioner is that he was apprehended while he along with other four persons was preparing to commit dacoity. From their possession arms and wine also recovered. It has been submitted on behalf of petitioner that he is in custody since 3.4.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. One country made pistol and two loaded cartridges is said to have been recovered from possession of petitioner. There is no compliance of Section 100 of the Code of Criminal Procedure.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.32624 of 2016 (3) dt.05-10-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Buxar Industrial Area P.S. Case no. 43 of 2016.
