2.The present application has been filed for modification of the order dated 24.05.2023 passed in Cr. Misc. No. 28741 of 2023 by which the petitioner was directed to be released on regular bail after framing of charge. 3.Learned counsel for the petitioner has submitted that trial of the case has been stayed by this Court in Criminal Misc. No. 32107 of 2023(Annexure-2) and because of the same, the charges could not be framed against the petitioner and the petitioner could not be released on bail because he was directed to be released after framing of charge.

4.The order dated 24.05.2023 passed in Cr. Misc. No. 28741 of 2023 is modified to the extent that "the petitioner,

No.44458 of 2023(2) dt.19-07-2023 2/2 named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-XXI, Patna/concerned Court below in connection with S. Tr. No. 329 of 2023/Jakkanpur P.S. Case No. 651 of 2022.

5.It is also subject to the condition that the petitioner would cooperate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioner. 6.The Court below will not wait for the framing of charge. Other conditions imposed in the order dated 24.05.2023 shall remain the same.

7.With the aforesaid observation and direction, this modification application is allowed.
