Petitioners seek bail in a case registered under section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act as well as section 130 of the Bihar Panchayat Raj Act. The first information report reflects that on the eve of Panchayat election, two groups of different candidates started pelting stones against each others. Police party went there and tried to pacify the matter but firings were made by both groups. Informant claims that mob attacked on polling booth and damaged public property. Petitioners are named in the first information report and it is alleged that they belong to group of Indu Mukhiya but no specific overt-act has been attributed against these petitioners. No.30311 of 2016 (2) dt.04-08-2016 others who attacked on the supporters of Indu Mukhiya and in the meantime, local police came there and started assaulting the supporters of Indu Mukhiya and when protest was made, informant of the present case had fired on Sarweshwarnand @ Lal. It is also informed that mother of the aforesaid injured Sarweshwarnand @ Lal filed complaint case bearing Complaint case no. 526/2016 and that is the reason of false implication of the petitioners and others in the present case.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in Harnaut P.S.
