JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Sections 414/34 of the Indian Penal Code.

As per the prosecution case, stolen motorcycle has been recovered from the house of the petitioner. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. House in question is the joint family property of the petitioner and no incriminating material has been recovered from the conscious possession of the petitioner. It is stated in paragraph 3 of the bail petition that the petitioner has got clean antecedent. Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No.40857 of 2022(2) dt.28-11-2022 2/2 bail submitting that stolen motorcycle has been recovered from the house of the petitioner as such he cannot escape responsibility.
