Petitioner is languishing in custody for the offences punishable under Sections 272/273 of the Indian Penal Code and Sections 30(a)/38(2) of the Bihar Prohibition and Excise Act, 2016.

From the backside of the line-hotel of this petitioner foreign liquor was recovered. From another place also liquor was recovered.

Submission is that the petitioner is in custody since 19.11.2016 and has stated on oath that he has got no criminal antecedent.

Considering the facts and circumstances, let

Patna High Court Cr.Misc. No.13286 of 2017 (2) dt.22-03-2017 2/2 petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani/Successor Court, in connection with Khajauli P.S. Case No.209 of 2016, with condition that petitioner shall file an affidavit before the learned Court-below stating therein that in future he shall not indulge in such activity.
