JUSTICE SUDHIR SINGH ORAL ORDER 20-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Section 379 of the I.P.C.

The prosecution story, in brief, is that in the night of 18.06.2015 one Bolero vehicle of the informant has been stolen from his door.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.10.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The petitioner has not been put on Test Identification Parade to ascertain his involvement in the present case.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Nawada in connection with Rajauli P.S. case No.134 of 2015.
