JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,149,323,337,353,379 and 307 IPC and sections 135 and 138 of Electricity Act.
The accusation is of consumption of electric energy unauthorizedly and the loss has been calculated of Rs.2140/- and the arrear is to the tune of Rs.19,998/-, thus total due amount is Rs.22,138/-. It is also alleged that the petitioner made assault to the informant when he went to raid the premises. It is submitted by learned counsel for the petitioner that the arrear of energy charges were against joint family house when the
Patna High Court Cr.Misc. No.26350 of 2015 (2) dt.21-07-2015 2/2 electric connection was in the name of late father of the petitioner and the entire due amount of Rs.22,138/- has already been deposited.
It is submitted by Mr. Vinay Kirti Singh, learned counsel for the Bihar Electricity Board that the petitioner does not deserve anticipatory bail in view of the fact that he made assault to the government servant.
Considering the fact that no perceptible injury was caused to the informant and statement has been made in paragraph 3 that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, Danapur, Patna in connection with Rani Talab P.S. Case No. 80 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
