It is jointly submitted at the Bar that Three-Man Enquiry Commission has been ordered to be constituted for looking into the matter of the liability of PDS dealers with respect to the foodgrains given to them for distribution under SCRY and Food for Work scheme vide order dated 21.09.2015 passed in C.W.J.C. No.5638 of 2015. The writ application was disposed of with a direction that upon payment of 50% of the demand, the certificate proceedings would remain stayed till the final receipt of inquiry commission regarding such district concerned and the amount involved in the certificate proceeding would vary on the outcome of the report of the said Enquiry Commission. Patna High Court CWJC No.24315 of 2013 (2) dt.29-03-2016 2 / 2 dealer would be required to pay the amount for which they would be found liable or if they have paid in excess, then the excess amount would have to be returned to them but if it is found that further amount beyond 50% is payable the same would be recovered through pending certificate proceeding itself.
