The Petitioner seeks bail in Ekma P.S. Case No. 99 of 2011, U.T. No. 26 of 2017 instituted for the offence under Section 302/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that the petitioner is a lady. There is allegation in the written report that she was armed with iron Dab but in the narration part of the FIR it has been alleged that she gave Chaku blow on the abdomen of the deceased. From the narration in the written report it further appears that four persons caused injury to the deceased but in the post mortem report, it appears that the Doctor has found three injuries caused by sharp cutting weapon on the person of the
Patna High Court Cr.Misc. No.11127 of 2017 (4) dt.18-05-2017 2/2 deceased.
It has further been submitted that father and brother of the petitioner have been enlarged on bail by co-ordinate Benches of this Court by orders dated 11.2.2015 passed in Cr. Misc. No. 50558/2014 and 7.9.2016 passed in Cr. Misc. No. 35333 of 2016.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate 13th, Saran at Chapra in connection with Ekma P.S. Case No. 99 of 2011, U.T. No. 26 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) S.Pandey/- U T
