JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Saran (Chapra) Town P.S. Case No. 208 of 2019 registered for the offences punishable under Sections 420, 419, 467 and 468 of the Indian Penal Code.

Prosecution case is that the petitioner got appointment as Constable by allowing other person to sit in examination instead of him.

Submission of learned counsel for the petitioner is that now the petitioner has suffered a lot as he has been removed from the service and he is ready to abide by any condition that may be imposed on him if anticipatory bail is granted to him. Heard learned APP also.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.38007 of 2019(3) dt.29-08-2019 2/2 petitioner surrender within a period of two weeks from the receipt of this order and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran, in connection with Saran (Chapra) Town P.S. Case No. 208 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to cooperate in the investigation.
