JUSTICE BIRENDRA KUMAR ORAL ORDER 27-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.

The FIR was lodged on missing of daughter of the informant. The petitioner and others are under suspicion. The victim girl, on recovery, has stated in the statement under Section 164 Cr.P.C. that she has love affair with co-accused Wasi Alam and she had voluntarily gone with Wasi Alam and has already married with him.

Considering the statement of victim girl under

Patna High Court Cr.Misc. No.3564 of 2017 (3) dt.27-03-2017 Section 164 Cr.P.C., let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran at Motihari/Successor Court, in connection with Madhuban P.S. Case No.192 of 2016, subject to the condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
