JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-04-2018 The petitioner is apprehending his arrest in connection with Pakridayal P.S. Case No. 93 of 2015, registered for offences punishable under Sections 387/120B of the Indian Penal Code. Allegation against the petitioner as per F.I.R. is of demand of Rangdari of Rs. 10 lac and of threatening. It has been submitted on behalf of the petitioner that petitioner has been falsely implicated in the present case. Petitioner is not named in the F.I.R. and his name has transpired in the confessional statement of co-accused and the mobile no., from which the rangdari has been demanded, does not belong to petitioner.

Having heard both sides, considering the facts and
Patna High Court Cr.Misc. No.14872 of 2018 (3) dt.25-04-2018 2/2 circumstances of the case, this application is disposed of with direction to petitioner to surrender before the court below within a period of four weeks and on his surrender the court below shall release the petitioner on provisional bail on furnishing bail bonds of Rs. 25,000 /- (Rs. Twenty Five Thousand) with the two sureties of like amount each to the satisfaction of concerned court below with condition that he will cooperate in the investigation and make himself available as and when required by the police and on event of his failure to appear before the police on two consecutive dates, his bail bonds shall be cancelled and also with further condition that once charge-sheet is submitted and if there is material against the petitioner, he will have to surrender in the court below and pray for regular bail, which will be considered by the court below on the basis of materials available at that time.
