JUSTICE SUDHIR SINGH ORAL ORDER 21-05-2015 The petitioner is apprehending his arrest in connection with Dhansoi P.S. Case No. 107 of 2014 for the offences instituted under Sections 409 and 420 of the I.P.C.

Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that the named accused being Head Master was entrusted for construction of School building for which Rs. 7,79,700/- has been released in the account of School Shiksha Committee, but after elapse of one and half year, the work has not even been started, though money has been withdrawn and in this way the petitioner has embezzled the amount mentioned above as well as also affected the 'Right to Education Act' by the petitioner.

Further it has been submitted that the petitioner has got no criminal antecedent. Further it has been submitted on behalf of the petitioner that the petitioner is ready to deposit amount of Rs. 20,000/- in the court below which shall be subject to final disposal of the case.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the fact that the petitioner is ready to deposit amount of Rs. 20,000/- in the court below which shall be subject to final disposal of the case, let the above named, petitioner, be released on bail in the event of his arrest or surrender before the learned court below within a period of eight weeks from today in connection with Dhansoi P.S. Case No. 107 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Buxar, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
