2. Petitioner apprehends his arrest in connection with Singhwara PS Case No. 30/2023 dated 05.02.2023 registered for the offence punishable under Sections 341/324/325/307/354/379/504/506/ 34 of the IPC.
3. As per FIR, the petitioner along with other accused persons assaulted the informant and the petitioner, allegedly, put Gamchha around the neck of the informant's brother and twisted the same.
4. Learned counsel for the petitioner submits that the petitioner and his entire family members have been implicated in this case due to family dispute relating to partition. He next submits that the informant is the nephew of the petitioner and from perusal of the order impugned, it would be evident that no injury has been caused to the brother of the informant on his
Patna High Court CR. MISC. No.40469 of 2023(2) dt.02-08-2023 2/2 neck. Other accused persons i.e., two female and one male members of the family of petitioner have been granted anticipatory bail by the learned Sessions Judge, Darbhanga itself.
5. Regards being had to the submissions made by the parties, taking into consideration that both the parties are closely related and no sign of injury has been found on the neck of the brother of the informant, I am inclined to grant anticipatory bail to the petitioner.
6. Accordingly, let the petitioner, named above, in the event of arrest or surrender within four weeks from today, be released on anticipatory bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 1st Class, Darbhanga in connection with Singhwara PS Case No. 30/2023, subject to the condition as laid down under Section 438(2) CrPC.
