JUSTICE SUDHIR SINGH ORAL ORDER 16-07-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.

The prosecution story, in brief, is that the main accusation against the petitioners is of assaulting the informant, his son and daughter by using dab and Bhuzali with intention to commit the murder of the informant and also of taking away Rs. 1,96,000/- from the possession of the informant. It has been submitted on behalf of the petitioners that it is a case and counter case. It is further submitted that the injury caused by the informant is on his left thumb, which is not

Patna High Court Cr.Misc. No.25950 of 2015 (5) dt.16-07-2015 2/2 vital part of the body. It is further submitted that accused side have also sustained injuries, which have not been explained by the prosecution and the same cast serious doubt upon the prosecution case.

On behalf of the State, it has been submitted that the petitioners are named in the FIR.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan, in connection with Bhagwanpur P.S.case No. 245 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
