The petitioner seeks regular bail in connection with Town (Motihari) P.S. Case No. 717 of 2017, registered for the offence punishable under Sections 365 and 366-A of the Indian Penal Code.

The allegation is regarding the son of the petitioner having abducted the victim girl and the boy as well as the girl are said to be traceless.

The learned counsel for the petitioner has referred to the case diary and has submitted that till date, no material has been collected by the police so as to find the complicity of the petitioner in the alleged occurrence. It is further

Patna High Court Cr.Misc. No.25420 of 2018(4) dt.28-05-2018 2/2 submitted that as far as the petitioner is concerned, he is the father of the person, who is said to have abducted the victim girl. The petitioner is stated to be having a clean antecedent and he is languishing in custody, no fault of his from 24.12.2017.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Town P.S. Case No. 717 of 2017.
